The Public Records Act (Chapter 42.56 RCW) is a Washington State law that allows you to review government records. Public records include documents in all formats, whether electronic or paper, that relate to government operations or conduct. All of Commerce’s documents are considered public records, and are subject to public review, unless a law specifically exempts certain information from disclosure.

Exemptions are listed in the Public Records Act, while others are found elsewhere in Washington and Federal law. Many of these exemptions are designed to protect privacy rights and legitimate business interests.

Computer | Security – Computer and Telecommunications Networks – RCW 42.56.420(4) — Information regarding the infrastructure and security of computer and telecommunications networks, consisting of security passwords, security access codes and programs, access codes for secure software applications, security and service recovery plans, security risk assessments, and security test results to the extent that they identify specific system vulnerabilities. |
Domestic Violence | Client records of domestic violence programs, or community sexual assault programs or services for underserved populations – RCW 42.56.370, RCW Chapter 40.24 — Client records maintained by an agency that is a domestic violence program or a community sexual assault program or services for underserved populations. |

HIPAA | 45 CFR § 164.514(b)(2) — Health Insurance Portability and Accountability Act (HIPAA) – Requirements for de-identification of protected health information. Broadband | Broadband Service Expansion Grant and Loan Program — Public Works Board — RCW 43.155.160(6)(g) — Confidential business and financial information submitted by an objecting provider under this subsection is exempt from disclosure under chapter 42.56 RCW. |
Security | Security RCW 42.56.420 The following information relating to security is exempt from disclosure under this chapter: (1) Those portions of records assembled, prepared, or maintained to prevent, mitigate, or respond to criminal terrorist acts, which are acts that significantly disrupt the conduct of government or of the general civilian population of the state or the United States and that manifest an extreme indifference to human life, the public disclosure of which would have a substantial likelihood of threatening public safety, consisting of: (a) Specific and unique vulnerability assessments or specific and unique response or deployment plans, including compiled underlying data collected in preparation of or essential to the assessments, or to the response or deployment plans; and (b) Records not subject to public disclosure under federal law that are shared by federal or international agencies, and information prepared from national security briefings provided to state or local government officials related to domestic preparedness for acts of terrorism |
Affordable Housing occupants and tenants | Affordable Housing occupants & tenants- RCW 42.56.395 Information obtained by the department of commerce under chapter 43.185A RCW during monitoring activities or contract administration that reveals the name or other personal information of occupants or prospective tenants of affordable housing, or the street address of the residential real property occupied or applied for by tenants or prospective tenants of affordable housing, is exempt from disclosure under this chapter. |
Other Statue | RCW 42.56.070(1) (1) Each agency, in accordance with published rules, shall make available for public inspection and copying all public records, unless the record falls within the specific exemptions of subsection. General questions or requests for information are not typically Public Disclosure Requests. Commerce is not required to create new records, collect or analyze information, or conduct legal research under the Public Records Act. You will receive a response within five business days. We will respond in one of several ways:
- Provide the records (or a link to the portion of our website that contains the records).
- We may request clarification.
- If the documents are not readily available, we will provide a reasonable estimate of time that it will take us to produce the records.
- For some large requests, we may have to produce the records on a partial or installment basis. We will also provide the estimated timeframes for each incremental delivery as we work through your request.
- When legal exemptions apply, we may deny the request in whole or in part, either by withholding the requested records or redacting the documents, including an explanation of the denial.
There may be a fee for electronic records that are provided electronically. There is no fee for the in-person inspection of public records. We may charge 15 cents per page for paper copies of records or other actual costs associated with mailing or producing the records.
